1. Introduction

Welcome to Hiding Elephant. These Terms of Service ("Terms") govern your access to and use of Hiding Elephant's services, including our AI logo generator tool and any other products and services that we offer (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.

2. Account Registration

To use our Service, you must create an account. You may register using your Google account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your account credentials and for any activity under your account. You must notify us immediately of any unauthorized use.

3. Subscription Plans

We offer both free and paid subscription plans.

• Paid subscribers have full commercial rights to generated content (subject to the restrictions in Section 5).
• Free users retain personal, non-commercial rights only.

Subscription fees are billed on a recurring basis as described at purchase. You may cancel at any time, but no refunds are given for unused subscription periods.

4. Use of Service

You agree to use the Service lawfully and in compliance with all applicable laws. You must not:

• Interfere with or disrupt the Service or its servers.
• Attempt unauthorized access to the Service, accounts, or networks.
• Use automated tools (robots, scrapers, etc.) without our written permission.
• Restrict or inhibit other users' enjoyment of the Service.
• Generate or create harmful, hateful, discriminatory, violent, sexually explicit, or illegal content. This includes but is not limited to content that promotes hate speech, harassment, violence, illegal activities, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.

Prohibited Content Policy: Hiding Elephant has a zero-tolerance policy for harmful or illegal content. Any user found creating such content will have their account immediately suspended or terminated without warning or refund. We reserve the right to report illegal content to the appropriate authorities.

5. User Content

By using the Service, you may create content, including any graphics, images, logos, designs, or other visual content generated using our tools ("User Content").

Paid User Content Rights:

For Paid Subscribers: You retain full ownership of all User Content you create. Hiding Elephant does not claim any rights to your content and will not use it for marketing, promotional, or any other purposes beyond providing the Service to you.

Free User Content Rights:

For Free Plan Users: All content (including any graphics, images, logos, designs, or other visual content) generated using a Free plan account is subject to additional restrictions:

• No Commercial Rights: Free users are granted personal, non-commercial use rights only. You may not use, sell, license, or otherwise commercially exploit any content generated under a Free plan.
• Platform Ownership for Marketing: Hiding Elephant retains full ownership and unrestricted rights to all content generated by Free plan users. We may use such content for marketing, promotional materials, portfolio showcases, social media, advertising, or any other purpose at our sole discretion, without compensation to you.
• Upgrade for Commercial Rights: To obtain full commercial rights to your generated content, you must upgrade to a paid subscription plan.
• Retroactive Rights: Upgrading to a paid plan does not retroactively grant you commercial rights to content generated while on a Free plan. Only content generated after upgrading receives commercial rights.

Important Restrictions on Commercial Rights:

• No Rights to Third-Party Trademarks: We do not grant you any rights to use any generated graphics, images, or other content that contains or resembles existing trademarks, brand names, brand marks, logos, or other protected intellectual property of third parties (e.g., "Google," "Nike," "Apple" logos).
• AI-Generated Intellectual Property: Our AI models may generate graphics, images, or other content that resembles or includes existing brands, copyrighted works, trademarked materials, or other protected intellectual property. It is solely your responsibility to ensure that any content you create and use complies with all applicable intellectual property laws. You cannot generate content featuring protected marks (such as a Nike logo) and claim commercial rights to it.
• User Responsibility: You must review all AI-generated graphics, images, and other outputs to ensure they are legally clear and do not infringe on any third-party rights before any use, especially commercial use.
• Indemnity: You agree to indemnify and hold harmless Hiding Elephant from any claims, damages, or liabilities arising from your use of generated graphics, images, or other content in violation of these Terms or any law, including intellectual property infringement.

6. Intellectual Property

All rights in the Service, including its software, design, graphics, and text, belong to Hiding Elephant or our licensors. You may not copy, modify, distribute, sell, or reverse-engineer the Service or its software without permission.

AI-Generated Content Uniqueness: Graphics, images, and other content generated by our AI models may be similar to content generated for other users. Hiding Elephant makes no guarantee of uniqueness or exclusivity of generated content, even for paid subscribers.

7. Termination

We may suspend or terminate your access without notice if you violate these Terms, including creating prohibited content as outlined in Section 4. Upon termination, all rights granted to you will cease immediately. However, Hiding Elephant retains all rights to any graphics, images, or other content generated under Free plans, even after account termination. Enforcement and Removal Rights: We reserve the right to remove or block any user-generated graphics, images, or other content at our sole discretion, especially if it may infringe third-party intellectual property rights or violates our prohibited content policy.

8. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, error-free, or secure operation.

9. Limitation of Liability

To the maximum extent permitted by law, Hiding Elephant is not liable for indirect, incidental, or consequential damages, including lost profits, data loss, or reputational harm, arising from:

• Your use or inability to use the Service.
• Unauthorized access to our servers.
• Interruptions or errors in the Service.

10. Changes to Terms

We may update these Terms at any time. Updates will be posted on our website with the revised effective date. Continued use after changes means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of Florida, USA, without regard to conflicts of law. You agree to the jurisdiction of the courts in Florida, USA.
